1. Definitions

In these Terms and Conditions: "Azurion", "we", "us" refers to the yacht charter operation based at 18/6 Chalong Bay Road, Mueang Phuket, Phuket 83130, Thailand. "Guest" or "you" refers to the individual or group booking a charter. "Charter" refers to any booked departure, whether a half-day sail, full-day trip, or multi-day passage. "Agreement" refers to the booking confirmation, these Terms, and any written correspondence forming part of the charter arrangement.

2. Acceptance of Terms

By making an enquiry, confirming a booking, or boarding an Azurion vessel, you indicate your acceptance of these Terms. Bookings are accepted for individuals aged 18 and over. Minors may participate as guests when accompanied by a responsible adult who accepts these Terms on their behalf.

3. Charter Services

Azurion provides private crewed yacht charters departing from Chalong Bay, Phuket. Services include the Chalong Afternoon Sail, the Southern Islands Full Day charter, and the Phuket–Phi Phi multi-day passage. Specific inclusions for each charter are described on our website and confirmed at the time of booking.

All charters are private — we do not group-book passengers from different parties onto the same vessel.

4. Booking and Confirmation

A booking is considered confirmed once Azurion has issued a written confirmation by email and, where applicable, a deposit or full payment has been received. Availability is not reserved until confirmation is issued.

We reserve the right to decline bookings at our discretion. Booking confirmation does not constitute a guarantee of departure in cases of weather, mechanical issues, or safety concerns.

5. Pricing and Payment

All prices are quoted in Thai Baht (฿) unless otherwise stated. Charter prices as published cover the vessel, crew, fuel, and provisions as specified per charter type. Park entry fees are included for the Southern Islands and multi-day charters. Additional requests — extended hours, special dietary provisions, extra equipment — may incur additional charges, which will be agreed in writing before the charter.

Payment terms will be specified at confirmation. We accept bank transfer and cash. All quoted prices are inclusive of Thai VAT where applicable.

6. Cancellation and Changes

We may cancel or reschedule a charter due to weather conditions, mechanical issues, crew unavailability, or other circumstances outside our reasonable control. In such cases, we will offer rescheduling at no additional charge or a full refund of amounts paid. We are not liable for consequential costs such as travel or accommodation.

6.3 Date Changes

Requests to change a confirmed charter date will be accommodated where possible, subject to availability. Date changes requested fewer than 5 days before departure may not be possible.

7. Guest Responsibilities

Guests agree to: follow all safety instructions provided by the captain and crew; behave in a manner that does not endanger themselves or others on board; arrive at the departure point at the agreed time; disclose any medical conditions relevant to sailing before departure; not bring controlled substances on board; and treat the vessel and its equipment with reasonable care.

The captain has final authority over all matters relating to vessel safety and route decisions while at sea. Failure to comply with reasonable crew instructions may result in early return to port without refund.

8. Health and Safety

Guests participate in all water activities at their own risk. Life jackets are available for all passengers and must be worn when instructed by the crew. Azurion is not liable for personal injury sustained during swimming, snorkeling, or other water activities undertaken voluntarily by guests.

Guests with known health conditions, particularly cardiac conditions, respiratory conditions, or conditions affecting buoyancy and swimming, should consult a medical professional before booking and disclose relevant information to us.

9. Intellectual Property

All content on the Azurion website — including text, images, and design — is the property of Azurion or used under licence. You may not reproduce, distribute, or publish this content without our written permission.

10. Disclaimers

Charter services are provided in good faith and with reasonable care. However, we make no representations regarding specific weather conditions, marine wildlife sightings, visibility at snorkel sites, or any other factors outside our control. Itineraries described on the website are indicative and may be adjusted on the day.

11. Limitation of Liability

To the extent permitted by Thai law, Azurion's liability to any guest arising from a charter shall not exceed the total charter fee paid by that guest. We are not liable for indirect, consequential, or incidental losses including missed flights, travel disruptions, or loss of earnings.

Nothing in these Terms limits liability for death or personal injury caused by our negligence.

12. Indemnification

You agree to indemnify Azurion against claims, losses, or expenses arising from your breach of these Terms or your negligent or unlawful conduct during a charter.

13. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Phuket Province, Thailand.

We encourage guests to contact us directly with any concerns before initiating formal proceedings. Most issues can be resolved promptly through direct communication.

14. Changes to These Terms

We may update these Terms from time to time. The current version is always published at this URL. Bookings confirmed under a prior version of the Terms will continue to be governed by those Terms unless you agree otherwise.
